Martin County Coal Co. will pay $3.25 million to state of Kentucky for October 2000 impoundment failure. Lawsuit has also been filed by West Virginia Dept. of Environmental Protection, scheduled for trial 12/2002. MSHA has levied the maximum $110,000 fine against the company, and Massey Energy, Martin Co. Coal's parent company, has spent more than $41.5 million on the clean-up.
